What is an eVisa?

An eVisa is a digital record of your immigration status in the UK. The UK government provides a digital service for checking and proving your immigration status. This system, known as the eVisa, simplifies the process for individuals to view and share their immigration status information.

Instead of a physical document, your status is stored electronically and can be accessed online. This provides a convenient and secure way for you to prove your right to live, work, and study in the UK. eVisa will start from 1st Jan 2025. UKVI Visa will no longer on BRP card any more.

How to Access Your eVisa

To access your eVisa, follow these steps:

Visit the Online Portal:

Go to the UK Government's online immigration status page .

Use your UK Visas and Immigration (UKVI) account details to sign in. If you do not have an account, you will need to create one.

View Your Status:

Once signed in, you can view details of your immigration status, including any conditions or restrictions that apply.

Share Your Status:

To prove your status to others, you can generate a share code. This code allows third parties to view your status online. Simply provide them with the code and the link to the eVisa check page .

How to Sharing Your eVisa

Generate a Share Code:

Log into your online account and navigate to the ‘Prove your status’ section.
Click on ‘Share your status’ to generate a share code.

Provide the Code:

Give the generated share code and the corresponding link to the person or organization requiring proof of your status.

Third Party Access:

The recipient can go to the eVisa check page , enter the share code, and view your status details.

Why does my BRP card expire on 31 /12/2024 ?

I have Indefinite leave to Remain but my BRP card expires on 31 December 2024

You do not need to apply for a BRP replacement if your BRP expires on 31 December 2024, this is because that from 1st Jan 2025, you will be able to prove your immigration status online. BRP card will no longer need from 1st Jan 2025. Your immigration status (your visa) allows you to stay longer. UKVI will update their information on how to prove your immigration status in early 2024.

Set up a innovative business in the UK

You can apply for an Innovator visa if you want to set up and run an innovative business in the UK - it must be something that’s different from anything else on the market and your business or business idea has been endorsed by an approved body, also known as an endorsing body and you meet the other eligibility requirements.

Your business needs to be new - you cannot join a business that is already trading, innovative - an original business idea which is different from anything else on the market and viable, with potential for growth (scalable). Your proposed business needs to meet a market need or create a competitive advantage.

You can stay with Innovator visa for 3 years. If you want to stay longer you can apply to extend your stay for another 3 years when your visa is due to expire. No limit on the number of times you can extend.

If you are applying outside the UK, the fee is £1021.

If you are extending or switch the visa in the UK, the fee is £1277. You may also need to pay £19.20 to have your biometric information (fingerprints and photo) taken.

Your application fee will be automatically reduced by £55 if you’re from one of the following countries: Austria, Belgium, Croatia, Republic of Cyprus, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Luxembourg, Malta, Netherlands, North Macedonia, Norway, Poland, Portugal, Slovakia, Spain, Sweden or Turkey. This reduction only applies to your visa application. Your partner and children will still need to pay the full application fee. You also need to pay the healthcare surcharge as part of your application.

There is a financial requirement for this visa. If you want to set up a new business, you need to have at least £50000 in investment funds. If your business is already established and has been endorsed for an earlier visa or you’ve changed your business and already agreed it with your endorsing body. You also need to have at least in £1270 in your bank account of 28 consecutive days. As you cannot use money from your investment funds to support yourself, they need to be kept separately. Therefore, you need to have £51270 in total. However, if you are applying from in the UK and has been in the UK for more than 12 months at the time of application you will automatically meet the financial requirement (sufficient funds to establish and maintain themselves in the UK). £285 is needed for your dependant partner, £315 for your first child and £200 for each subsequent child. If you have a team with other Innovator applicants, you cannot share the same investment funds. Each team member must have £50000 individually.

You need the following documents to apply: an endorsement letter to show that an endorsing body has assessed your business or business idea, dated no more than 3 months before the date of the application, a valid passport or other document that shows your identity and nationality, bank statements showing you’ve had at least £1,270 in savings in your bank account for 28 consecutive days before you apply, proof that you meet the English language requirement, evidence of your investment funds (if you’re setting up a new business) and your tuberculosis test results if you’re from a country where you have to take the test.

To meet the funding requirements, the following sources are acceptable: endorsing body or other source where the endorsing body has verified the funds are available, a UK organisation employing at least 10 people, an overseas organisation, a UK organisation which employs less than 10 people or an individual third party, funds held by applicant or Funds already invested in business. Your money may not be held in the UK. But if the money is not held in the UK, all of the funds need for the investment must be freely transferable to the UK and able to be converted to pounds sterling. Money held in an overseas account but in a financial institution regulated by the Financial Conduct Authority (FCA) will satisfy this requirement. Money held overseas in an institution must be transferrable to the UK. The applicant must provide evidence to confirm this, such as a document from the financial institution. Banks are not, however, required to guarantee that this money will be transferred.

You can apply for settlement with Innovator visa if you have continually resided in the UK for at least 3 years immediately prior to application. You also need to provide an endorsement letter. You need to achieve at least 2 of the following:

at least £50,000 has been invested into the business and actively spent furthering the business plan
the number of the business’s customers has at least doubled within the most recent 3 years and is currently higher than the mean number of customers for other UK businesses offering comparable main products or services
the business has engaged in significant research and development activity and has applied for intellectual property protection in the UK
the business has generated a minimum annual revenue of £1 million in the last full year covered by its accounts
the business is generating a minimum annual revenue of £500,000 in the last full year covered by its accounts, with at least £100,000 from exporting overseas
the business has created the equivalent of at least 10 full-time jobs for settled workers
the business has created the equivalent of at least 5 full-time jobs for settled workers. Each job must have an average salary of at least £25,000 a year (gross pay, excluding any expenses)

As spouse is included in the definition of ‘partner’, the financial requirement of a spouse visa is the same as that of partner. The applicant must meet the financial requirement as a minimum income requirement.

Minimum income requirement

The minimum income requirement for a Partner such as spouse is £29000.

The minimum income requirement increases to £29000. However if your spouse or partner visa applied before 11th April 2024, the minmum income requirement is £18600, there is a higher financial requirement to be met where the application includes sponsorship of a child at the same time (or at any time before the applicant reaches settlement), or where the sponsor is already sponsoring a child. An additional gross annual income of £3,800 is required for the first child sponsored in addition to the partner and an additional £2,400 for each further child.

The minimum income requirement can be met by gross annual income above alone or in combination with cash savings of the applicant’s partner and/or the applicant, above £16000, held by the partner and/or the applicant for at least 6 months and under their control. This additional savings need to be equivalent to 2.5 times the amount which is the difference between the gross annual income from the sources listed in paragraph E-ECP.3.2.(a)-(d) and the total amount required under paragraph E-ECP.3.1.(a).

If the higher financial requirement and other requirements are met, the applicant child or children will be granted leave in line with the applicant partner. If the partner and a child or children are applying together, and the higher financial requirement and other requirements are not met, applicants will be considered on the basis of exceptions and exceptional circumstances, where leave will either be granted on a 10 year route to settlement or refused.

Meaning of Child

The higher financial requirement applies to biological children, step-children (in certain circumstances), adopted children (in certain circumstances, including de facto adoptions), and children coming for the purpose of adoption who are subject to immigration control and applying for limited leave to enter or remain under Appendix FM, Appendix Armed Forces or the paragraphs of Part 8.

The financial requirement applies to a child who is:

not a British Citizen (including an adopted child who acquires British citizenship)
not an Irish Citizen
not a European Economic Area (EEA) national resident in the UK with free movement rights under the Immigration (European Economic Area) Regulations 2016 for as long as those rights remain in force until the end of the grace period on 30 June 2021
have not been or is being granted leave to enter or remain under the EU Settlement Scheme (including settled status in accordance with paragraph EU2 or EU2A and pre-settled status in accordance with EU3 and EU3A of Appendix EU)
is not settled in the UK or who qualifies for indefinite leave to enter
does not qualify under Part 8 or Appendix Armed Forces of the Immigration Rules in a category to which the financial requirement does not apply

In the Representative of an Overseas business application , there are requirements for the employee who will be the sole representative in the UK.

Recruit from outside of the UK

The employee have been recruited and employed outside the UK by the business. They intend to represent, and intend to work full-time as a representative of that overseas business only.

Shareholding in the company

If you own or control a stake in the overseas business, this must not amount to you owning or controlling a majority of that business. Sole Representatives cannot own more than 50% of the shares, control more than 50% of the voting rights, be the self-employed owner of that business, be the sole-proprietor of that business or be in a partnership agreement in which they own more than 50% of that business.

Media Representative job requirements in the UK

As a Media Representative applicant, you must be based mainly in the UK and working on a UK long-term assignment. Journalists are the usual applicants but other employees like producers, news cameramen and front-of-camera personnel are also possible. However,

Secretaries and other administrative support staff do not qualify and must apply under an alternative immigration route if one is available. Your employer must have its headquarters and principal place of business outside the UK. An overseas media business can have more than one representative in the UK at the same time.

Work experience and position in the company

You need to be employed outside the UK by the overseas business in a senior job role. You need to have a track record of setting up branches or subsidiaries for other businesses, if they have been employed specifically to undertake this role. You also need to have authority to negotiate and take operational decisions once in the UK, as indicated by their role in the overseas business’s hierarchy. You must be a direct employee of the overseas business at the point at which they first seek permission in this route. If the Sole Representative is subsequently employed by the UK branch or subsidiary they have established, this is permitted provided the link to the overseas business is maintained and they still have sole executive responsibility for the direction of the branch or subsidiary. The overseas business cannot have more than one Sole Representative.

Sole Representatives cannot be an agent hired to market the business’s products in the UK (they are normally self-employed and provide services for a fee), a sales representative or buyer who only fulfils that role for the business: however, senior sales staff who are also responsible for other functions, for example, marketing and distribution, may qualify as a sole representative of an overseas business or a secretary or personal assistant accompanying a Sole Representative.

5 factors for 10 Years Long Residence ILR application

Your application for Indefinite Leave to Remain via 10 years long residence will be refused if your continuous residence is broken.

10 years long residence rules require the applicant to stay in the UK lawfully and continuously for 10 years. If the continuous is broken, the Indefinite Leave to Remain application on the basis of 10 years long residence will be refused. There are a few factors to assess whether the applicant’s 10 years long residence is broken. 5 factors for 10 Years Long Residence ILR application are as follows.

Absence from the UK

The 10 years long residence rules require the applicant cannot leave the UK for more than 540 days or 180 days for a single trip. If the applicant has been absent from the UK for more than the 540 days or 180days, the continuous is broken. Usually, the application is refused unless there are some compelling ground.

Some compelling grounds:

According to 10 years long residence guidance, there are some compelling grounds for the case worker to consider if the applicant has more than 540 days absences. For example: the absence due to a significant or serious illness or frailty or particularly difficult family circumstances.

Application submitted outside of the UK

If the applicant made a successful entry clearance application to return to the UK, the continuous is broken if he left the UK with no valid leave and did not submit an application within 28 days before 24 ^th November 2016. If the applicant left the UK before his valid leave expired and returned to the UK within six months, then the continuous is not broken.

Visitor visa counts towards long residence

The applicant may apply for a visitor visa to come to the UK and subsequently apply for entry clearance to study, work or live in the UK. The time spent on a visitor visa will count towards to lawful continuous residence in the UK

A couple's life is not always a happy ending. Sometimes, their relationship is broken, If you are a spouse/partner visa holder, your visa is based on your relationship. Therefore, the first thing you need to do is to tell the Home Office about your divorce， relationship broken or separation from your partner.

By Email

You can send an email to the Home Office to tell them that the relationship has ended.

The email shall include both you and your ex-partner’s name, date of birth, address, passport number and Home Office reference number. You can find your Home Office reference number on letters sent from the HomeOffice.

If either of you have children in the UK, you must also include their names and dates of birth, names of their parents or guardians, and who they live with, how much time they spend with you or your ex-partner, how much child maintenance or financial help you give each other and details of any family court cases you’re involved in.

There are forms you must attach to your email. If you do not want the Home Office to tell your ex-partner any details from your email, you need to print and sign the public statement. If you are happy for the HomeOffice to tell your ex-partner details from your email, you need to print and sign the consent form. You need to attach a scan of that signed form to your email. Both forms give the Home Office permission to contact your ex-partner at the address you give. You should send your email to StatusReviewUnit@homeoffice.gov.uk and include ‘MARRIAGE BREAKDOWN’ in the subject line.
